Terms of Use of the heli.spot community server
Effective from 1 August 2026
1. Introductory provisions
- These terms govern the use of the heli.spot community server (the “Server”).
- The Server is operated by LION Helicopters s.r.o., Company ID: 28763548, registered office at Ráby 119, 533 52, Pardubice, Czech Republic, contact e-mail: info@lionheli.aero (the “Operator”).
- The Server is intended primarily for pilots, students, instructors, operators, technicians, people interested in helicopter flying and other members of the vertical aviation community.
- By registering, signing in or using the Server, the user confirms that they have read and agree to these terms.
2. Registration and access to the Server
- Access to certain parts of the Server may be subject to registration and approval of the application by the Operator.
- The user must provide truthful and up-to-date information when registering. The user must not impersonate another person or create an account in order to circumvent a previously imposed restriction or ban.
- There is no legal entitlement to have an application accepted or a user account created.
- The Operator may reject an application where there is a reasonable and justified ground, in particular where:
- the applicant provided untrue, incomplete or misleading information;
- there is reasonable suspicion that the account is to be used contrary to the purpose of the Server;
- the applicant has previously seriously or repeatedly breached the Server rules;
- admitting the applicant could jeopardise the safety, credibility or proper functioning of the community;
- the applicant is attempting to circumvent a restriction or ban;
- the registration cannot be accepted for capacity, technical or organisational reasons.
5. When deciding whether to admit a user, the Operator will not act arbitrarily or in a discriminatory manner.
6. The user is responsible for securing their account and login credentials. If misuse is detected, the user must inform the Operator without undue delay.
3. Rules of conduct
Users must communicate factually, politely and with respect for other members of the community. The following are prohibited in particular:
- insults, personal attacks, threats, harassment or bullying;
- discriminatory, hateful or otherwise grossly inappropriate expressions;
- publishing untrue or intentionally misleading information;
- unsolicited advertising, spam or repeated commercial offers without the Operator's consent;
- publishing personal, confidential or non-public operational information without authorisation;
- content infringing legal regulations or the rights of third parties;
- content infringing copyright, trademarks or other intellectual property rights;
- promotion of dangerous, unlawful or irresponsible conduct;
- attempts to compromise the security, availability or proper functioning of the Server;
- using the Server in a manner contrary to its community and professional focus.
Differing professional opinions are welcome. They must, however, be presented factually and without personal attacks.
4. Aviation and professional information
- Content published on the Server serves primarily for community discussion and the sharing of experience.
- User contributions do not replace applicable legal regulations, flight manuals, operational documentation, manufacturer instructions, decisions of competent authorities or professional training.
- Before using any information when planning or performing a flight, maintenance or other aviation operation, the user must verify its correctness and currency in the relevant official sources.
- The user is responsible for decisions made on the basis of community contributions. The Operator does not verify the correctness of all published information and does not warrant its completeness or currency.
5. User-generated content
- The user who published a contribution is responsible for its content.
- The user may publish only content to which they hold the necessary rights and whose publication does not infringe legal regulations, contractual obligations or the rights of third parties.
- By publishing a contribution, the user grants the Operator a non-exclusive, royalty-free licence to store, technically process and display the content to the extent necessary for the operation and promotion of the Server.
- The user may request the removal of their content or account. Some information may be retained where necessary to comply with legal obligations, protect the Operator's legitimate interests or preserve the meaning of a discussion that has already taken place. Personal data is processed in accordance with a separate privacy policy.
6. Content moderation
- The Operator is entitled to review content published on the Server and to take measures to protect the community, users and the proper functioning of the Server.
- The Operator may in particular:
- change the categorisation or format of a contribution;
- hide or remove inappropriate content;
- lock a discussion;
- warn a user about a breach of the rules;
- temporarily restrict certain account functions;
- temporarily or permanently ban a user's access to the Server.
3. Content may be considered inappropriate in particular where it breaches these terms, legal regulations, the rights of others, the rules of decent communication, safety principles or the professional focus of the Server.
4. In the case of a less serious breach, the Operator may first warn the user. A prior warning is not, however, a condition for moderation action.
5. In the case of repeated inappropriate conduct, the Operator may temporarily or permanently ban the user's access.
6. In the case of a serious breach, a contribution may be removed or access banned immediately, in particular in cases of threats, harassment, publication of unlawful content, endangering safety, misuse of personal data, disruption of the Server or circumvention of an earlier ban.
7. Moderation measures will be proportionate to the nature, seriousness and frequency of the breach. The Operator will inform the user of the reason for the action to a reasonable extent, unless legal, security or serious operational reasons prevent this.
7. Reporting inappropriate content and review of decisions
- Users may report inappropriate or unlawful content using the “Report” function, where available, or at the e-mail address info@lionheli.aero.
- A report should identify the contribution, describe the reason and, where applicable, include any other information needed to assess it.
- A user whose contribution has been removed or whose account has been restricted may request a review of the decision at info@lionheli.aero, no later than 30 days after being notified of the decision.
- The Operator will assess the request reasonably and inform the user of the outcome. Submitting a request does not in itself suspend the effects of the measure taken.
8. Availability and liability of the Operator
- The Operator does not guarantee uninterrupted availability of the Server or the preservation of all its functions and may temporarily limit its operation, in particular for technical, security or operational reasons.
- The Operator is not liable for opinions, offers or other content published by users. This is without prejudice to liability that cannot be excluded or limited under applicable law.
- The Operator is not liable for agreements or transactions concluded between users. Each user must independently verify the identity, authorisation and trustworthiness of the other party.
- The Operator may modify, suspend or discontinue the Server or any part of it.
9. Termination of an account
- The user may cancel their account at any time using the procedure stated on the Server or by a request sent to the Operator.
- The Operator may restrict or cancel an account in the cases set out in these terms.
- Cancellation of an account is without prejudice to rights and obligations which, by their nature, are to survive its termination.
10. Changes to the terms
- The Operator may amend these terms to a reasonable extent, in particular in connection with changes to the Server, legal regulations or security and operational requirements.
- The user will be informed of any material change through the Server or by contact e-mail with reasonable advance notice.
- By continuing to use the Server after the changes take effect, the user confirms that they have read the new wording.
11. Final provisions
- These terms are governed by the law of the Czech Republic, without prejudice to the rights granted to users by mandatory legal regulations.
- If any provision proves to be invalid or ineffective, this does not affect the validity of the remaining provisions.
- These terms take effect on 1 August 2026.
